Noel Oehlers

Director

Noel joined the Characterist team in 2013, having practiced in two of Singapore’s leading law firms. He practices pre-dominantly in dispute resolution, specialising in civil and commercial litigation.

Noel has advised and represented clients on a broad range of contentious matters before all levels of the Singapore Courts and arbitral tribunals. Noel’s client matters include commercial, partnership and company, estate, property, employment and investment disputes. He has acted in the prosecution of cross-jurisdictional claims, including matters involving corporate and commercial fraud and the recovery and tracing of assets.

Noel has been described as “very responsive and effective” and has been lauded for his “passion and utmost integrity” in his advocacy work.

Outside his practice, Noel volunteers with Pro Bono SG, and is an avid sports fan.

Representative Cases & Transactions

  • Successfully obtaining Mareva relief in aid of a foreign ICC Arbitration. Application to discharge the freezing order was successfully resisted before the High Court and the Court of Appeal (see Solvadis Commodity Chemicals GmbH v Affert Resources Pte Ltd [2013] SGHC 217).
  • Represents The Ngee Ann Kongsi in a high profile and widely reported property dispute involving the ownership of the Teochew Building at Tank Road.
  • Succeeding in a High Court minority oppression action, obtaining a buy-out and other orders for an excess of US$8 million, without the Court requiring a valuation of the minority shareholding.
  • Successfully acting in a partnership dispute, which was heard in the High Court for 16 days and concerned a complex factual matrix spanning 20 years.
  • Successfully acting in Singapore International Arbitration Centre (SIAC) proceedings in respect of a franchise dispute concerning parties’ “best endeavours” obligations.
  • Successfully setting-aside the disciplinary proceedings of a well-known club against a client in the High Court, having obtained an interim injunction pending the successful outcome of the matter (see Khong Kin Hoong Lawrence v Singapore Polo Club [2014] 3 SLR 241).
  • Representing a high net worth individual in contentious probate proceedings in the High Court concerning a complex and lengthy history between parties in relation to the estate, and a substantial interaction with proceedings in Australia concerning the testatrix’s non-Singapore assets.
  • Representing employment agencies in a High Court claim against its former general manager and his co-conspirators, for breaches of fiduciary and other duties, breach of confidence, unlawful means conspiracy to injure and in dishonest assistance.
  • Successfully obtaining Norwich Pharmacal relief to facilitate the recovery and tracing of assets in relation to a US$1 billion fraud perpetrated on a foreign bank.
  • Representing co-defendants in a compilation copyright claim by a listed company in the High Court involving novel points of law.
